UAE Sees Growing Interest in Regulated Crypto Funds as Institutional Investment Evolves

The UAE is seeing growing interest in regulated cryptocurrency funds as digital asset investment expands beyond trading platforms towards more sophisticated institutional structures.

UAE-based Oryx Legal Consultants is advising multiple digital asset fund sponsors exploring the establishment of investment vehicles within the Dubai International Financial Centre (DIFC) and Abu Dhabi Global Market (ADGM), highlighting the demand for specialised legal and regulatory advice in the evolving sector.

UAE Regulatory Frameworks Shape Crypto Fund Structures

The growing interest comes amid continued regulatory developments across the UAE’s two international financial centres.

In January 2026, the Dubai Financial Services Authority (DFSA) introduced changes placing greater responsibility on regulated firms to assess the suitability of crypto tokens. Meanwhile, the Financial Services Regulatory Authority (FSRA) at ADGM has continued refining its virtual asset regulatory framework.

These developments are shaping how fund sponsors assess the legal structures, regulatory permissions and operational requirements needed to establish professionally managed digital asset investment vehicles.

Institutional Investors Drive Demand for Sophisticated Structures

Vanessa Abernethy, Co-Founder of Oryx Legal Consultants and an early legal adviser to digital asset funds in the UAE, said the market was moving towards more sophisticated investment structures.

“The conversation has moved beyond whether crypto funds can be established in the UAE. Today, the focus is on how these funds are structured, governed and operated to meet the expectations of professional investors,” Abernethy said.

She added that different investment strategies require distinct legal and operational considerations, whether a fund focuses on established cryptocurrencies or emerging blockchain ventures.

Getting the regulatory and operational structure right from the outset, she said, is essential to building a fund that meets investor expectations and applicable requirements.

Custody, Valuation and Liquidity Present Key Challenges

Digital asset funds face considerations that can differ significantly from those encountered by traditional investment vehicles.

These include establishing appropriate custody arrangements, determining reliable asset valuation methods, managing liquidity and meeting regulatory compliance obligations. The continuous trading of digital assets and the complexities of holding and safeguarding them can add further operational challenges.

Fund sponsors must therefore assess how these requirements affect their investment strategy, risk management and governance arrangements before launching a vehicle.

DIFC and ADGM Offer Different Regulatory Pathways

Both DIFC and ADGM provide regulatory frameworks for financial services and certain digital asset investment activities. However, their differing rules and authorisation requirements mean that fund sponsors need to assess which jurisdiction best fits their proposed strategy and operating model.

“Establishing a successful digital asset fund is not simply about choosing a jurisdiction. It requires aligning the investment strategy, regulatory permissions and operational infrastructure within a structure that is both commercially viable and appropriately governed,” Abernethy said.

The choice of jurisdiction can influence a fund’s structure, permitted activities, service-provider arrangements and ongoing compliance obligations.

UAE Positions Itself for Institutional Digital Asset Investment

As digital assets become more integrated into institutional investment strategies, the UAE’s financial infrastructure and developing regulatory environment are attracting attention from fund sponsors seeking a regulated base for their activities.

The growing interest in DIFC and ADGM reflects the importance of aligning investment objectives with appropriate governance, custody and compliance arrangements as the digital asset sector develops.
